What do I offer and receive when purchasing Exclusives?

Exclusive Deviations are one-of-a-kind works (media, images, or videos) for sale on DeviantArt, available for purchase by a single owner and optionally available for resale to a new owner. Here you'll find guidance for both Sellers and Buyers regarding the sale and purchase of Exclusive deviations.

Selling Guidelines

Sellers have the option to offer unique works as an Exclusive Deviation to buyers on DeviantArt. 
  1. Ensure you own all rights to the work and hold the copyright before listing it for sale as an Exclusive Deviation.
  2. Once listed as an Exclusive, you cannot make or sell copies of the deviation on DeviantArt.
  3. Choose one or both sale methods:
    1. Fixed Price: The first user to purchase will become the owner.
    2. Accepting Offers: Accept offers from multiple potential buyers (with a specified minimum price) and choose any offer, subject to DeviantArt's review and approval process.
  4. You remain the intellectual property owner unless otherwise agreed with the buyer.
  5. Allow or restrict the ability for the Deviation to be resold. More information on Exclusive Resales can be found here.
  6. After purchase, the Deviation remains in your profile's gallery with both your username as the creator and the buyer's username as the owner.
  7. To delete a purchased Exclusive Deviation, you must have the current owner’s consent.

Buying Guidelines

When purchasing an exclusive deviation, buyers should carefully read these terms as well as any specifications put forth from the seller. 
  1. If you're the first to purchase a fixed-priced deviation, you immediately become the owner.
  2. Submit multiple offers can be made on Exclusives set by the seller as "Accepting Offers." Your offer can be withdrawn anytime while the sale is active. Once the duration ends, if the seller accepts your offer, ownership is transferred to you.
  3. Your purchased Exclusive Deviation may appear in your profile's Exclusives tab and will be displayed in both your and the creator's profile, showing both usernames.

Reselling Guidelines

Exclusive Deviations may be eligible for resale on the DeviantArt platform if initially permitted by the seller.
  1. When allowed, buyers can resell the deviation using DeviantArt's platform features. The buyer becomes the new seller and sets resale criteria.
  2. The original seller (creator) will automatically receive royalties from any resale. DeviantArt manages these payments directly.
  3. Upon resale, the new owner is displayed, alongside previous owners and purchase details.

Exclusive Ownership

When a Buyer becomes the “Owner” of a certain Exclusive Deviation that they purchased, it means that they are the current holder of that Deviation on the DeviantArt platform. Unless otherwise agreed between the Buyer and the Seller, the Seller shall remain at all times the sole owner of the intellectual property associated with the Deviation purchased. The Buyer’s rights to the work will be in accordance with the detailed specifications and terms of the offered Deviation and Deviant Art’s Terms of Service. Once an Exclusive Deviation is successfully purchased, both the Seller’s username (as the Creator) and the Buyer’s username (as the Owner) will appear on the Deviation. The Exclusive Deviation will be displayed both in the Seller’s profile Gallery and in the Buyer’s profile depending on their settings.
